What is a Mutation Certificate?

Mutation Certificate is the document required for the transfer of the property from an existing owner to the new owner. The Mutation Certificate of land is also known as ‘Dakhil Kharij’. Though a mutation certificate of property is not a legal document, however, it is still essential when one wants to sell or transfer his property in the future. Mutating a property means getting it recorded under the name of the new owner in the land revenue department which helps them fix property tax liabilities.

Types of Mutation

There are mainly two types of Mutation Certificate:

  • Mutation of Agricultural lands
    In case of the Agricultural land it is compulsory for the individual to get the mutation certificate of the property. One cannot transfer the ownership of the agricultural land without the mutation certificate. Further, if the government is acquiring the land the compensation is provided only when the individual has a mutation certificate of the property.
  • Mutation of Non-agricultural lands
    In case of the non-agricultural lands such as Flats, buildings etc, the ownership of the document is not affected by the mutation certificate. However, the owner will not be able to avail the electricity, water and other utility facilities.

Why mutation certificate is important?

The process of applying for the Mutation of property varies from one state to another. A rough idea of the offline application process for filing mutation of a property is listed as follow:

  • Step 1 : Go to the sub-registrar’s office and register for the mutation of property.
  • Step 2 : Fill the land mutation application form.
  • Step 3 : Submit the filled application form along with the relevant documents to the designated authority.
    Note: When submitting the application form, you will be provided a transaction ID. Save it for future reference.
  • Step 4 : The sub-registrar will place your request for mutation certificate to the concerned authority.
  • Step 5 : Designated authority will ask you for relevant documents to ensure that the property acquisition is not in violation of any of the provisions of the State’s land revenue and land reforms rules. The relevant documents are:
    • Copy of Sale Deed
    • Indemnity Bond & Affidavit
    • Latest property tax receipt
  • Step 6 : Once the verification is successfully completed, the concerned department will process the request for the mutation of property.
  • Step 7 : The authorized government officer will issue the mutation certificate of the land in a few days.
